1. Scope
These Terms of Use apply to the use of the Dokiny EMS platform and all associated services (hereinafter "Platform") provided by CASE Deutschland GmbH, Grüner Ring 126, 38108 Braunschweig, Germany (hereinafter "CASE" or "we").
By using our Platform, you agree to these Terms of Use. If you do not agree with these terms, please do not use the Platform.
2. Service Description
Dokiny EMS is an AI-powered production intelligence platform for electronics manufacturing. The Platform provides:
• Knowledge Hub with work instructions and process documentation
• AI-powered Operator Copilot (Chat & Voice)
• Production data integration (SPI, SMT, AOI, AXI, ICT)
• Quality analytics and defect classification
• End-to-end traceability
• Real-time dashboards and KPIs
We reserve the right to modify, update, or discontinue features of the Platform without prior notice.
3. User Rights and Intellectual Property
All content published on this Platform (texts, images, graphics, software, audio, video, and animation files, as well as their arrangement) is subject to copyright and other intellectual property protection laws.
The content may not be copied, distributed, modified, or made accessible to third parties for commercial purposes without our express written consent. Some areas of the Platform may contain content subject to the copyright of those who provided it.
Users are granted a limited, non-exclusive, non-transferable license to use the Platform for their internal business purposes in accordance with these Terms.
4. User Obligations
Users agree to:
• Provide accurate and complete registration information
• Maintain the confidentiality of their account credentials
• Use the Platform only for lawful purposes
• Not attempt to gain unauthorized access to any part of the Platform
• Not interfere with the proper functioning of the Platform
• Comply with all applicable laws and regulations
5. Data and Content
Users retain ownership of all data and content they upload to the Platform. By uploading content, users grant CASE a limited license to process, store, and display such content as necessary to provide the Platform services.
CASE does not claim ownership of user data. User data is processed in accordance with our Privacy Policy and applicable data protection laws.
6. Platform Availability
We strive to provide the Platform without interruption. However, downtime cannot be excluded even with the greatest care. We reserve the right to modify or discontinue the Platform at any time.
Scheduled maintenance will be announced in advance when possible. We are not liable for any damages resulting from Platform unavailability.
7. Limitation of Liability
We do not guarantee the accuracy, completeness, or quality of the information provided. Liability claims against CASE relating to material or immaterial damages caused by the use or non-use of the information provided are generally excluded.
All offers are non-binding. CASE expressly reserves the right to change, supplement, delete, or temporarily or permanently discontinue parts of the pages or the entire offer without prior notice.
Liability for direct or indirect damages arising in connection with the use of this Platform is excluded unless such damages are based on intent or gross negligence or liability cannot be legally excluded.
8. Third-Party Links
Our Platform may contain links to external third-party websites. We have no influence on the content of these linked websites. The respective provider or operator of the pages is always responsible for the content of the linked pages.
The linked pages were checked for possible legal violations at the time of linking. Illegal content was not recognizable at the time of linking.
9. Contractual Services
For the provision of services or the sale of products by CASE, separate contracts and General Terms and Conditions (GTC) apply, which are agreed upon when the contract is concluded.
These Terms of Use exclusively govern the use of the Platform and do not establish any contractual relationship regarding the provision of services.
10. Changes to Terms of Use
We reserve the right to change these Terms of Use at any time. The current version is always available on our Platform. We recommend that you review these Terms of Use regularly.
Continued use of the Platform after changes to these Terms constitutes acceptance of the modified Terms.
11. Applicable Law and Jurisdiction
These Terms of Use and all legal relationships between us and the user are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
To the extent permitted by law, the place of jurisdiction for all disputes arising from or in connection with these Terms of Use is Braunschweig, Germany.
12. Severability Clause
Should individual provisions of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
